1. LEGAL INFORMATION AND ACCEPTANCE

These provisions govern the use of the Internet portal service (the ‘Portal‘) that Atitlan Desarrollos Inmobiliarios, S.L. (‘ATDI‘) makes available to Internet users.

In order to comply with the provisions contained in Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (‘LSSI‘), we inform you that ATDI, with registered office at Calle Don Juan de Austria, 30, 4th floor, 46002 Valencia, Spain and C.I.F. number B-98923402, is registered in the Valencia Commercial Registry, Volume 10307, Folio 56, Section 8, Sheet V-177011.

Access to the Portal is free except for the cost of connection through the telecommunications network provided by the contracted access provider. Certain services are exclusive to our investors and their access is restricted.

The use of the Portal attributes the status of Portal user (the ‘User‘) and implies acceptance of all the conditions included in this document (the ‘Legal Notice‘). The provision of the Portal service has a duration limited to the time the User is connected to the Portal. Therefore, the User must carefully read this Legal Notice on each occasion they intend to use the Portal, as it and its conditions of use contained in this Legal Notice may be subject to modifications.

Some Portal services accessible to the User may be subject to particular conditions, regulations, and instructions which, where applicable, replace, complement, and/or modify this Legal Notice and must be accepted by the User before the corresponding service provision begins. Likewise, in cases where it is necessary for the use of any of the services included in the Portal, the introduction of a username (‘login‘) and password (‘password‘), the User commits to make diligent use and not to make their login and password available to third parties, and must communicate to ATDI, as soon as possible, their loss, theft, or any other circumstances that may have compromised their secrecy.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY

All contents of the Portal, understanding these as merely enunciative, the texts, graphics, images, photographs, icons, technology, software, links and other audiovisual or sound contents, as well as their graphic design and source codes (the ‘Contents‘), are intellectual property of ATDI or third parties, without any of the exploitation rights recognized by current regulations on intellectual property over them being understood to be assigned to the User, except those that are strictly necessary for the use of the Portal.

The trademarks, trade names or distinctive signs are owned by ATDI or third parties, and it cannot be understood that access to the Portal attributes any right over said trademarks, trade names and/or distinctive signs.

3. CONDITIONS OF USE OF THE PORTAL 3.1 General

3.2 Contents

The User agrees to make correct use of the Portal in accordance with the Law and this Legal Notice. The User will be responsible to ATDI or to third parties for any damages that may be caused as a result of the breach of said obligation.

The use of the Portal for purposes harmful to the assets or interests of ATDI or third parties or that in any other way overload, damage or disable the networks, servers and other computer equipment (hardware) or computer products and applications (software) of ATDI or third parties is expressly prohibited.

In the case of registration, the User agrees to: (i) truthfully provide the requested data and keep it updated; (ii) properly safeguard the login and password provided by ATDI, as identifying elements and enablers for access to certain services offered on the Portal, committing not to transfer their use or allow access to them by third parties; (iii) communicate to ATDI, as quickly as possible, the loss or theft of the login and/or password as well as any risk of access to them by a third party; and (iv) not use false identities, nor impersonate others in the use of the Portal or in the use of any of the Portal services, including the use of passwords where applicable.

The User agrees to use the Contents in accordance with the Law and this Legal Notice, as well as with other conditions, regulations, and instructions that may be applicable in accordance with the provisions of clause 1. As a purely illustrative example, the User, in accordance with current legislation, must refrain from:

a) Reproducing, copying, distributing, making available, publicly communicating, transforming, or modifying the Contents except in cases authorized by law or expressly consented to by ATDI or by whoever holds the exploitation rights in each case.

b) Extracting and/or reusing all or a substantial part of the Contents that ATDI makes available through the Portal.

3.3 Data Collection Forms

Without prejudice to the provisions of clause 5 of this Legal Notice, as well as the privacy policies accessible from the Portal that may be applicable at any time, the use of certain services or requests directed to ATDI are subject to the prior completion of the corresponding User registration.

3.3 Introduction of Links to the Portal

All information provided by the User through the Portal forms for the above purposes or any others must be truthful. To this end, the User guarantees the authenticity of all the data communicated and will keep the information provided to ATDI perfectly updated so that it responds, at all times, to the User’s real situation. In any case, the User will be solely responsible for any false or inaccurate statements made and for any damage caused to ATDI or third parties by the information provided.

The Internet user who wants to introduce links from their own web pages to the Portal must comply with the conditions detailed below, and lack of knowledge of these does not exempt them from the responsibilities derived from the Law:

a) The link will only connect to the home page or main page of the Portal but may not reproduce it in any form (inline links, copying of texts, graphics, etc.).

b) It will be prohibited in all cases, in accordance with the applicable and current legislation at all times, to establish frames or frames of any kind that envelop the Portal or allow the visualization of the Contents through Internet addresses other than those of the Portal and, in any case, when they are viewed together with content unrelated to the Portal in a way that: (I) produces, or may produce, error, confusion or deception in users about the true origin of the service or Contents; (II) represents an act of unfair comparison or imitation; (III) serves to take advantage of the reputation of the brand and prestige of ATDI; or (IV) is otherwise prohibited by current legislation.

c) No false, inaccurate, or incorrect statements about ATDI, its partners, employees, investors, or about the activities or services it provides will be made from the page that introduces the link.

d) In no case will it be expressed on the page where the link is located that ATDI has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies, or supervises the services of the sender.

e) The use of any denominative, graphic, or mixed trademark or any other distinctive sign of ATDI within the sender’s page is prohibited except in cases permitted by law or authorized in writing by ATDI and always allowing, in these cases, a direct link with the Portal in the manner established in this clause.

f) The page establishing the link must faithfully comply with the law and may not under any circumstances have or link to its own or third-party content that: (I) is illegal, harmful, or contrary to morality and good customs (pornographic, violent, racist, etc.); (II) induces or may induce in the User the false conception that ATDI subscribes to, endorses, adheres to, or in any way supports the ideas, manifestations, or expressions, legal or illegal, of the sender; (III) is inappropriate or irrelevant to ATDI’s activity in view of the location, content, and theme of the sender’s website.

4. DISCLAIMER OF LIABILITY

4.1 Of the Information

Access to the Portal does not imply an obligation on the part of ATDI to verify the truthfulness, accuracy, adequacy, suitability, completeness, and timeliness of the information provided through it. The contents of this page are of a general nature and do not constitute, in any way, the provision of an advisory service, nor a recommendation for the execution of any type of legal business, or any other type, therefore such information is insufficient for personal or business decision-making by the User.

The information contained in the Portal cannot be considered under any circumstances as an assessment by an independent expert, nor as investment advice, being solely for informative and guidance purposes, with the aim of serving as an introduction, without having analyzed the investment profiles or characteristics of the recipients of the information contained therein, nor its suitability or convenience, presenting the information in a generic manner, not being directed to a specific profile or a single recipient. Similarly, this information cannot be considered as an analysis report or as a recommendation directed to the general public.

ATDI is not responsible for decisions made based on the information provided in the Portal nor for damages caused to the User or third parties due to actions that have as their sole foundation the information obtained from the Portal.

4.2 Quality of Service

Access to the Portal does not imply an obligation on the part of ATDI to control the absence of viruses, worms, or any other harmful computer element. It is the User’s responsibility, in any case, to have adequate tools for the detection and disinfection of harmful computer programs.

ATDI is not responsible for damages caused to the computer equipment of Users or third parties during the provision of the Portal service.

4.3 Service Availability

Access to the Portal requires services and supplies from third parties, including transport through telecommunication networks whose reliability, quality, continuity, and operation are not the responsibility of ATDI. Consequently, the services provided through the Portal may be suspended, canceled, or become inaccessible, prior to or simultaneously with the provision of the Portal service.

ATDI is not responsible for damages of any kind caused to the User that result from failures or disconnections in telecommunication networks that cause the suspension, cancellation, or interruption of the Portal service during its provision or prior to it.

4.4 Contents and Services Linked Through the Portal

The Portal access service includes technical linking devices, directories, and even search tools that allow the User to access other Internet pages and portals (the ‘Linked Sites‘). In these cases, ATDI acts as an intermediary service provider in accordance with Article 17 of the LSSI and will only be responsible for the contents and services provided in the Linked Sites to the extent that it has effective knowledge of their illegality and has not deactivated the link with due diligence. In the event that the User considers that there is a Linked Site with illegal or inappropriate content, they may communicate it to ATDI in accordance with the procedure and effects established in clause 6, without this communication in any case entailing the obligation to remove the corresponding link.

In no case should the existence of Linked Sites presuppose the existence of agreements with those responsible or owners of the same, nor the recommendation, promotion, or identification of ATDI with the manifestations, contents, or services provided.

ATDI does not know the contents and services of the Linked Sites and therefore is not responsible for damages caused by the illegality, quality, outdatedness, unavailability, error, and uselessness of the contents and/or services of the Linked Sites nor for any other damage that is not directly attributable to ATDI.

5. COMMUNICATION OF ILLEGAL AND INAPPROPRIATE ACTIVITIES

In the event that the User or any other Internet user becomes aware that the Linked Sites refer to pages whose contents or services are illegal, harmful, denigrating, violent, or contrary to morality, they may contact ATDI indicating the following details:

a) Personal data of the communicant: name, address, telephone number, and email address;

b) Description of the facts that reveal the illegal or inappropriate nature of the Linked Site;

c) In the event of violation of rights, such as intellectual and industrial property, the personal data of the owner of the infringed right when it is a person other than the communicator. Additionally, you must provide the title that accredits the legitimacy of the rights holder and, where applicable, that of representation to act on behalf of the holder when it is a person other than the communicator;

d) Express declaration that the information contained in the claim is accurate.

The receipt by ATDI of the communication provided for in this clause will not imply, as provided in the LSSI, effective knowledge of the activities and/or content indicated by the communicator.

6. LEGISLATION AND JURISDICTION

This Legal Notice is governed in all and each of its aspects by Spanish law.
